Welcome to the Christopher and Dana Reeve Paralysis Resource Center (PRC) Web Site.

This Terms of Use Agreement ("Agreement") is a legal agreement between you ("User") and the PRC. By accessing and using any materials on this Web Site at http://www.paralysis.org/ ("Web Site") – other than to read this Agreement for the first time – User acknowledges that he or she has read, understood and agrees to comply with all terms and conditions set forth herein.

The PRC reserves the right to change these terms and conditions periodically at its sole discretion. User’s continued use of this Web Site constitutes acceptance of the terms and conditions stated at the time of use.

This Web Site is available only to those who agree to the terms and conditions set forth in this Agreement without modification.

The PRC may collect information about the Users of this Web Site. Collection of this information is governed by the PRC Online Privacy Policy.

User Conduct

User is responsible for all use of User’s account (including screen name and password) and e-mail address, if applicable. User shall be solely responsible for maintaining the security of User’s passwords. Users agree that all the information posted or accessed will be used only for User’s personal purposes. User acknowledges and warrants that it will not commercially exploit nor make any unauthorized use of this Web Site or any information or content posted on this Web Site, without the express written permission of the PRC. User may not engage in any conduct or action that is prohibited by law or violates any country, federal, state or local laws. Neither the PRC nor any sources that may provide the PRC with information for this Web Site are directly or indirectly responsible for practicing medicine, dispensing medical services, or providing treatments as part of this Web Site. User also agrees that the PRC shall not be liable for any loss or damage of any sort incurred as the result of using any third party’s web site. Mention of third party companies and web sites on the PRC Web Site is for informational purposes only and does not constitute an endorsement or recommendation. When User accesses a third party web site, User does so at his or her own risk and acknowledges that the PRC is not responsible or liable for any content, advertising, products or other materials available from such third party sites.

Applicable Laws

The Agreement and the relationship between User and the PRC shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to its conflict of laws provisions. Any controversy or claim arising out of or relating to this Agreement shall be resolved in a New Jersey court. User agrees to submit to the personal and exclusive jurisdiction of the courts located in the State of New Jersey. User agrees that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to this Agreement must be filed within one (1) year after such claim or cause of action arises, or will be barred forever.

Limitation of Liability

User expressly understands and agrees that the PRC shall not be liable for any loss or damage (direct, indirect, punitive, actual, consequential, incidental, special, exempt, or otherwise) resulting from any use of, or inability to use, this Web Site, or resulting from any errors or omissions in the Content of this Web Site, regardless of the basis upon which liability is claimed, even if advised by the PRC of the possibility of such loss or damage. This limitation is subject to the provisions of any applicable law that may restrict its scope.

Disclaimer of Warranty

The PRC makes no warranty that this Web Site will meet User’s requirements, or that it will be uninterrupted, timely, secure, or error-free; nor does the PRC make any warranty as to the results that may be obtained from the use of the Web Site or as to the accuracy or reliability of any information obtained through the PRC.

The waiver by either party of a breach or right under this Agreement will not constitute a waiver of any subsequent breach or right. If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of this Agreement, which will otherwise remain in full force and effect.

Any rights not expressly granted herein are reserved.
